2. Subject matter
These Terms govern the use of the digital menu service for restaurants provided through restaur.ai (also accessible at lacartaonline.de).
3. Acceptance
By signing up and using the service you accept these Terms. If you do not agree, do not use the service.
4. User account
To use the service you must create an account and keep it with truthful data.
- The data you provide must be true and up to date.
- You are responsible for the confidentiality of your password and for all activity on your account.
- You must be at least 18 years old or the legal age in your country, and have legal capacity to contract.
5. Plans and pricing
We offer the following plan types:
- Free: free of charge, with usage limits (articles, languages, etc.).
- Pro / Custom: paid, monthly or annual subscription with automatic renewal.
- AI credits: one-time purchase bundles for AI-powered features.
6. Billing
Subscriptions are charged in advance at the start of each period. Prices include VAT where applicable. Payments are processed via Stripe.
7. Cancellation
You can cancel your subscription at any time from your dashboard. Cancellation is effective at the end of the current billed period; it is not prorated.
8. Refunds
Except as required by applicable consumer law, payments are non-refundable once the period has started. Consumed AI credits are non-refundable.
9. Acceptable use
You agree not to:
- Use the service for unlawful purposes.
- Overload the infrastructure or attempt to circumvent limits.
- Upload content that infringes third-party rights (trademarks, copyright, image rights).
- Mass scrape, reverse engineer or decompile the service.
10. Intellectual property
The service, its code, brand and design are owned by the provider. We grant you a limited, non-exclusive and non-transferable license to use the service.
11. Your content
You retain ownership of the content you upload (menu, photos, restaurant data). You grant us a limited license to host it, display it to your customers and process it as needed to provide the service.
12. AI features
AI features (menu import, image generation, descriptions) may produce inaccurate results. It is your responsibility to review content before publishing it.
13. Availability
We make every reasonable effort to keep the service available 24/7, but we do not guarantee 100% uptime. Scheduled maintenance may occur.
14. Liability
Except for willful misconduct or gross negligence, our aggregate liability for any damage related to the service is limited to the amount paid by you in the 12 months prior to the causing event.
15. Termination
We may suspend or close accounts that violate these Terms. After termination, your content may be deleted within 30 days.
16. Changes
We may update these Terms. If changes are substantial we will notify you at least 30 days in advance. If you do not agree, you may cancel.
17. Governing law and jurisdiction
These Terms are governed by Spanish law. For consumers residing in the EU, mandatory local law also applies.
